Trusts and Estates

Our Estate Planning attorneys work closely with clients and their professional advisors to develop and implement comprehensive estate plans for individuals, business owners, corporate executives and other professionals. Because every client has individual needs, every estate plan is designed to fit each individual’s particular circumstances. Our attorneys employ a number of strategies to help our clients achieve their wealth transfer objectives and minimize state and federal estate, gift and generation skipping transfer taxes. Strategies include the preparation of wills and trusts, powers of attorney, prenuptial agreements, special needs trusts, asset protection trusts, life-time gifting plans involving family limited partnerships and limited liability companies, sales to intentionally defective grantor trusts, grantor retained annuity trusts, private foundations and charitable trusts.

Planning efforts frequently focus on the management and perpetuation of closely-held businesses including the preparation and implementation of partnership and shareholder agreements, buy-sell agreements and other documentation necessary for complex business situations.

In addition to estate, business, and charitable planning, our estate and trust attorneys advise individual and institutional fiduciaries, heirs and family members in all phases of the administration of trusts and estates. We prepare trust accountings, obtain court approval of those accountings and represent fiduciaries in formal and contested matters in the probate, state and federal courts. Our attorneys have considerable experience in representing fiduciaries and beneficiaries with respect to complex trust, estate and guardianship accountings, claims by or against fiduciaries for breach of fiduciary duty, removal and replacement of fiduciaries, contentious guardianship and conservator appointments, and trust constructions, mergers, terminations, reformations and more.

We draw on the talent not only of our Estate Planning attorneys, but also of our attorneys in other areas of the firm, when appropriate, to obtain optimal results for our clients, including our Corporate, Employment, Litigation and Real Estate practice groups.

Our Estate Planning attorneys focus on providing services to clients who are residents of New England and Florida.
