As a natural adjunct to the Firm’s other areas of business practice, the Firm’s attorneys counsel clients on all aspects of employment law. This includes review and development of employment applications, offer letters, handbooks and all other policies, and preparation and negotiation of employment contracts, consulting contracts, separation agreements/releases, confidentiality and non-competition agreements. We advise corporate clients in ways to conduct business (including disciplinary actions, reductions in force and terminations), in a manner that allows business to proceed while minimizing possible claims under the Civil Rights Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Fair Labor Standards Act and similar federal and state statutes. We assist clients with investigations and responses to discrimination and other employment claims.
The Firm represents its clients before all courts and administrative agencies concerning employment matters. We have been successful in a number of matters enforcing or challenging confidentiality or non-competition agreements. The Firm counsels clients with respect to bonus plans, option plans, stock appreciation rights plans and similar incentive plans. The Firm continues to develop its collective bargaining practice. While the majority of our practice in this area involves representation of employers, we do represent individuals from time to time primarily, but not exclusively, in the negotiation of employment and separation agreements.
